Jaipur, 18 September. The Rajasthan High Court has ordered the 19 -year -old accused to be released on bail on the condition of not using social media for three years in the case of uploading a 23 -year -old married photo and video on social media. A single bench of Justice Ashok Kumar Jain gave this order while accepting the second bail plea of the accused.
The court made it clear that after the accused is released on bail, neither would tampering with the evidence nor will directly or indirectly contact the victim or her family. Also, the accused will give an affidavit that he has no photo or video of the victim or any family member, and if it is, he will permanently destroy it before release. The court also said that after getting bail, it will not share any message to the victim or her family on WhatsApp, Telegram or any other messaging platform. The court warned that the bail would be canceled if any condition is violated.
In the bail plea, advocate Girish Khandelwal told the court that the petitioner has been falsely implicated in the case. He has no criminal history nor is there a possibility of absconding. The charge sheet has been produced and the victim’s statements have been recorded. The petitioner assured that he would not post any photo-video to the victim or her family nor would he use social media by any real or imaginary name.
The government lawyer protested that the petitioner has uploaded photos and videos of the married woman from a fake account of Instagram. The victim lodged a report on 21 February at Hindaun Sadar police station. The accused has tried to disturb the married life of the married woman, so she should not get bail.
After hearing both the parties, the court issued orders to release the accused on conditional bail.
