Karnataka High Court on Tuesday put a temporary stay on the arrest warrant of former cricketer Robin Uthappa. A warrant was issued against him in an alleged case of provident fund fraud. This interim relief was given to Uthappa by a bench headed by Justice Suraj Govindraj and an interim stay was put on all actions related to the warrant and PF case.
This decision was given on the petition of Robin Uthappa, in which he had demanded to cancel the recovery notice and arrest warrant issued against him. This warrant against him was issued by Bengaluru Police on the orders of the Regional PF Commissioner and Recovery Officer, in which Uthappa's arrest was considered certain.
Robin Uthappa is accused of fraud in PF, actually this dispute is related to a private firm Centaras Lifestyle Brand. Uthappa was its director from 2018 to 2020. According to the notice issued by the PF officials, the PF contribution of the employees was being deducted by the company, but this amount was not deposited in their accounts. This amount is approximately Rs 23.16 lakh.
Senior advocate Prabhuling Navadagi, appearing for Robin Uthappa, told the court that Uthappata had resigned from the post of director of the firm in 2020. Apart from this, even during his tenure, he was not involved in the day-to-day operations of the company. For this, he also had a contract with the company's founder Krishnadas Thandanand Hawde.
Uthappa's lawyer said that on December 22, Uthappa had told the authorities that he is not a director of this company and is not involved in any management or day-to-day functioning of the company and hence he should be booked under the EPF Act. Cannot be considered an employer. In this case, after hearing both the sides, the High Court has given its verdict.
